1. Introduction

These Terms and Conditions govern your use of the Franco Uomo website (francouomo.com) and all services offered by Franco Uomo, including appointments, custom and made-to-measure garment orders, ready-to-wear purchases, alterations, and the For Work program. By accessing this website or engaging our services, you agree to be bound by these Terms.

Where an individual written order agreement or invoice expressly conflicts with these Terms, the terms of the written order or invoice control. These Terms, together with any applicable order confirmation, invoice, and our Privacy Policy, constitute the entire agreement between you and Franco Uomo.

‍ ‍

Franco Uomo reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services following any changes constitutes acceptance of the revised Terms.

2. Eligibility and Website Use

‍ ‍

By using this website, you represent that you are at least 18 years of age, reside in a jurisdiction where use of this website is lawful, and are legally capable of entering into a binding agreement. To place an order, you must be able to lawfully enter into and form contracts on the Internet in accordance with the laws of the State of California.

‍ ‍

This website may occasionally be unavailable due to maintenance, updates, or circumstances outside our control. Franco Uomo is not responsible for any loss or inconvenience resulting from website unavailability or errors in website content. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate or timely sources of information.

3. Services

‍ ‍

Franco Uomo offers the following services:

  • Ready-to-wear (RTW) menswear and womenswear

  • Made-to-measure (MTM) garments

  • Bespoke custom garments

  • Alterations and garment fitting services

  • The For Work program (Go-To, Traveler, Refresh, Overhaul packages)

  • Styling consultations and appointments

  • Tie and accessory retail (in-store and online)

All services are subject to availability. Franco Uomo reserves the right to decline any order or service request at its discretion. Placing an order or booking an appointment does not constitute acceptance until confirmed in writing by Franco Uomo.

‍ ‍

Certain products or services may be available exclusively online through the website and may have limited quantities. Franco Uomo reserves the right to limit the quantities of any products or services offered, to limit sales to any person, geographic region, or jurisdiction, and to discontinue any product or service at any time without notice.

4. Appointments

‍ ‍

Booking

‍ ‍

Appointments may be booked online via francouomo.com or by calling 408.247.2121. Bookings are subject to availability and are not confirmed until you receive written confirmation from Franco Uomo.

‍ ‍

Cancellations and Rescheduling

‍ ‍

We ask that you provide at least 24 hours notice if you need to cancel or reschedule your appointment. Repeated no-shows or last-minute cancellations may result in a required deposit for future bookings.

‍ ‍

Consultation Fee

‍ ‍

Initial consultations are complimentary. Franco Uomo does not charge a consultation fee.

‍ ‍

5. Custom, Made-to-Measure, and Bespoke Orders

‍ ‍

Design Deposit

‍ ‍

When you commission a custom garment, a non-refundable Design Deposit of 10% of the order value is required to begin production. This deposit covers consultation, design, measurements, and fabric reservation. It is credited toward the final garment price as the order proceeds and is earned from the moment the order is placed.

‍ ‍

Cancellation Policy

‍ ‍

  • Before fabric is cut: You may cancel and receive a refund of your order less the non-refundable 10% Design Deposit. Fabric may be cut within 24 hours of order placement in some cases, so please contact us as early as possible if your plans change.

  • Once production has begun: Once your fabric is cut, your garment is yours alone. Cancellations are not accepted and no refund is available at this stage.

Client-Approved Specifications

‍ ‍

Before production begins, the client is responsible for reviewing and approving all fabric selections, colors, styling details, monograms, measurements, and other customization choices. Franco Uomo will seek written or verbal confirmation of these specifications. Once approved and production has commenced, changes to specifications may not be possible and may result in additional charges if accommodated.

‍ ‍

Fabric and Material Availability

‍ ‍

Fabrics, trims, buttons, linings, and other materials are subject to availability from our mill and supplier partners, including Scabal, Holland and Sherry, Fox Brothers, Loro Piana, and Dormeuil. If a selected material becomes unavailable before or during production, Franco Uomo will notify the client and offer an equivalent or suitable alternative subject to client approval.

‍ ‍

On the rare occasion that a specific fabric cannot be obtained and no suitable alternative exists, Franco Uomo will cancel the order and issue a full refund including the Design Deposit. You should never pay for a garment we cannot make.

‍ ‍

Production Timelines

‍ ‍

Standard production timelines are as follows:

‍ ‍

  • Ready-to-wear alterations: 7 to 14 business days

  • Made-to-measure garments: 6 to 10 weeks

  • Bespoke garments: 10 to 16 weeks or as quoted at time of order

‍ ‍

Rush production is available at an additional fee:

‍ ‍

  • 7 to 10 business days: 50% surcharge

  • 11 to 20 business days: 40% surcharge

  • 21 to 30 business days: 30% surcharge

  • 31 to 45 business days: 20% surcharge

‍ ‍

All timelines are estimates. Delays caused by fabric mills, shipping carriers, customs, or other circumstances outside Franco Uomo's control do not constitute a breach of agreement and do not entitle the client to cancellation or refund.

‍ ‍

Fittings and Adjustments

‍ ‍

Custom and made-to-measure orders include standard fitting adjustments as discussed at the time of order. Fit adjustments are a normal part of the tailoring process. Alterations required due to significant changes in the client's measurements after the order has been placed — including but not limited to weight change, changes in posture, pregnancy, or injury — are not manufacturing defects and may be subject to additional charges.

Design Changes After Ordering

‍ ‍

Any change requested after an order is submitted is sent to our production team. We cannot guarantee a change can be made and may not be able to confirm it until your garment arrives. Contact us as soon as possible and we will do everything we can.

‍ ‍

Quality and Craftsmanship

‍ ‍

Our quality control process catches nearly every error before a garment leaves production. If a garment ever arrives outside your approved design specification, Franco Uomo will make it right. By placing a custom order, the client acknowledges the handcrafted nature of the garment and accepts that minor variations in fabric shade, texture, drape, and finish are inherent to the production process and do not constitute defects.

6. Pricing, Taxes, and Payment

‍ ‍

All prices are listed in US dollars. Published starting prices reflect base configurations and do not include taxes, shipping, rush fees, premium fabric upgrades, custom linings, monogramming, or other additions. The confirmed order or invoice reflects the final agreed price.

‍ ‍

Within the United States, sales tax will be charged on orders shipped to California residents where applicable. Customers purchasing from outside the US will be charged for items and applicable shipping costs only. Import duties, taxes, and customs fees are the sole responsibility of the recipient and will be invoiced directly by the carrier or local tax authority. Franco Uomo strongly recommends contacting your local customs authority for a landed cost estimate before placing an international order.

Prices are subject to change without notice. The price applicable to your order is the price confirmed at the time of order.

‍ ‍

Franco Uomo accepts all major credit cards including Visa, Mastercard, Discover, and American Express, as well as installment payments through Klarna. Klarna installment payment terms are governed by Klarna's own terms and conditions, available at klarna.com. In the event of a failed or declined Klarna payment during an active order, Franco Uomo reserves the right to pause production until payment is resolved. Deposits already paid are non-refundable in this circumstance.

Franco Uomo uses SSL 256-bit encryption technology to protect all payment transactions. By making a purchase, you expressly authorize Franco Uomo to perform credit checks and anti-fraud verification. Personal information provided may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

‍ ‍

Full payment for all garments and services is due upon pickup or delivery unless otherwise agreed in writing.

‍ ‍

7. Orders and Order Acceptance

‍ ‍

All orders are subject to acceptance and availability. Unpurchased items left in your shopping cart are not reserved and may be purchased by other customers.

‍ ‍

Once an order has been placed, you will receive an email confirming the details of your order. This email is not an acceptance of your order. Acceptance of your order will be confirmed upon packing or production commencement. Franco Uomo will send a follow-up confirmation containing your Order ID and relevant tracking or status information. The sale contract is concluded in the State of California, USA, and the language of the contract is English.

Franco Uomo reserves the right to refuse or cancel any order at its sole discretion, including but not limited to situations where payment authorization cannot be obtained, where shipping restrictions apply, where pricing errors exist, or where orders appear to be placed by dealers, resellers, or distributors. Franco Uomo will not be liable to you or any third party for withdrawing any merchandise from the site or refusing to process an order.

‍ ‍

You agree to provide current, complete, and accurate purchase and account information for all transactions. You agree to promptly update your account information, including email address and payment details, so that Franco Uomo can complete your transactions and contact you as needed.

‍ ‍

Franco Uomo may store a record of your transaction for a minimum of one year.

‍ ‍

8. Shipping and Delivery

‍ ‍

Franco Uomo ships all online orders directly from our Santana Row boutique in San Jose, CA via UPS. We make every effort to ship orders the same day and guarantee shipping within 24 hours of order confirmation.

‍ ‍

Current shipping rates within the continental United States:

‍ ‍

  • UPS Ground: $13 flat rate (free on orders over $100)

  • UPS 2nd Day Air: $25 flat rate

  • UPS Overnight: $48 flat rate

‍ ‍

Shipments within the continental United States are insured up to $100 by default. Franco Uomo does not insure purchases from outside the continental United States during transit unless specifically requested and paid for by the customer.

‍ ‍

Franco Uomo may require a signature for delivery. If you waive the signature requirement, you agree that Franco Uomo may leave the package at the shipping address without obtaining proof of delivery, and you release and indemnify Franco Uomo from liability for any loss or damage resulting from unattended delivery.

‍ ‍

Estimated delivery times are estimates based on past experience and are not guaranteed. Franco Uomo is not responsible for delays caused by UPS or other carriers, incorrect addresses provided by the client, customs processing, or circumstances beyond our reasonable control. Risk of loss and title for shipped items pass to the client upon delivery to the carrier. Franco Uomo is not responsible for lost, stolen, or damaged packages after confirmed delivery. Additional shipping costs resulting from incorrect addresses are the responsibility of the client.

International orders may be subject to import duties, taxes, and customs fees which are the sole responsibility of the recipient.

9. Returns and Exchanges

‍ ‍

Ready-to-Wear

‍ ‍

If you are not satisfied with your ready-to-wear purchase, Franco Uomo will gladly provide an exchange or store credit. You must contact us and ship the item back within 14 days of receiving your order. No cash refunds are available. Franco Uomo does not provide a rental service.

‍ ‍

Items must be returned in unused, unworn, unstained, and undamaged condition with original packaging including any gift box or dust bag. All returns must be shipped with a label provided by Franco Uomo for identification and prompt processing. Unidentified returns may be returned to the sender.

‍ ‍

Franco Uomo will cover return shipping costs within the continental United States for eligible exchanges. The customer is responsible for shipping costs on the replacement item. Return shipping costs for international orders or those from Alaska and Hawaii cannot be covered.

‍ ‍

Store credit will be issued for the full purchase price, excluding original shipping costs.

‍ ‍

Flawed Goods

‍ ‍

Goods are considered flawed if received in damaged condition and you inform us within 5 days of receiving the shipment. If you would like to exchange a flawed item, Franco Uomo can only replace it with the same product in the same size, subject to availability. Where possible, Franco Uomo will offer to repair faulty items. If the item cannot be repaired and the same product is not available, you are entitled to a full refund.

Custom and Bespoke Orders

‍ ‍

All custom, made-to-measure, and bespoke garments are final sale. No returns or refunds are accepted once production has commenced. Franco Uomo is committed to client satisfaction and will work in good faith to address reasonable fitting concerns through alterations.

‍ ‍

Altered Garments

‍ ‍

Garments that have been altered — whether by Franco Uomo or any third party — are final sale and are not eligible for return or exchange.

‍ ‍

Colors

‍ ‍

Franco Uomo makes every effort to display product colors accurately on the website. However, we cannot guarantee that your monitor or screen will display colors accurately, and slight variations may occur.

‍ ‍

10. Alterations

‍ ‍

Alterations are available for garments purchased at Franco Uomo and, at our discretion, for garments purchased elsewhere. Alteration timelines and pricing will be quoted at the time of drop-off. Franco Uomo is not responsible for pre-existing damage, wear, or structural issues in garments brought in for alteration. Clients will be informed of any concerns before work begins.

11. Garment Pickup and Storage

‍ ‍

Clients will be notified when their garment is ready for pickup. We ask that garments be collected within 30 days of the ready notification. Garments not collected within 90 days of notification may be subject to a storage fee. Garments left unclaimed for 180 days or more may be treated as abandoned property in accordance with applicable California law. Franco Uomo will make reasonable attempts to contact the client before any such action is taken.

12. Garment Care and Liability

‍ ‍

Franco Uomo takes care in the handling of all garments entrusted to us. However, Franco Uomo is not liable for damage resulting from pre-existing conditions, manufacturing defects in third-party fabrics, or improper garment care by the client following delivery.

‍ ‍

Clients are responsible for following all care instructions provided with their garment. Franco Uomo does not warrant that garments will be free from normal wear, color variation due to lighting or environmental conditions, or minor dimensional variation inherent to handcrafted production.

‍ ‍

13. The For Work Program

‍ ‍

The For Work program packages — Go-To, Traveler, Refresh, and Overhaul — are subject to the terms communicated at the time of engagement. Package components and pricing are as quoted. For Work packages are non-transferable and must be used by the named client. Unused package components do not carry a cash value and are not refundable.

‍ ‍

14. Franco Circle

‍ ‍

Membership in the Franco Circle client program is by invitation and does not constitute a contractual obligation on either party. Event invitations, exclusive access, and associated benefits are offered at Franco Uomo's discretion and may be modified or discontinued at any time without notice.

‍ ‍

Franco Circle events may involve third-party venues, ticketing platforms, and service providers. Franco Uomo is not responsible for the acts or omissions of third-party providers. Tickets or access provided through Franco Circle events are non-refundable unless the event is cancelled by Franco Uomo directly.

‍ ‍

15. Photography and Content Consent

‍ ‍

Franco Uomo may photograph or record clients during fittings, events, and in-store visits for use in marketing, social media, editorial content, and brand communications. By engaging Franco Uomo's services or attending Franco Uomo events, clients consent to such use unless they notify us in writing prior to the session or event that they do not wish to be photographed. Franco Uomo will not sell client images to third parties.

16. Promotions and Gift Cards

‍ ‍

Promotional codes and discounts are subject to individual terms communicated at the time of the promotion. Unless otherwise stated, promotions cannot be combined with other offers, applied to prior purchases, or used on bespoke or custom orders. Promotional pricing is subject to change or discontinuation at any time.

Gift cards, where available, have no cash value, are non-refundable, and are governed by applicable California law.

‍ ‍

17. Third-Party Services

‍ ‍

Franco Uomo's website and services integrate with third-party platforms including but not limited to Klarna, UPS, Google, Meta, Squarespace, and scheduling providers. Franco Uomo is not responsible for the availability, accuracy, or conduct of third-party services. Use of third-party services is subject to their respective terms and privacy policies.

18. Intellectual Property

‍ ‍

All content on francouomo.com, including but not limited to photographs, copy, logos, brand assets, and design elements, is the property of Franco Uomo and may not be reproduced, distributed, or used without prior written permission.

‍ ‍

19. Force Majeure

‍ ‍

Franco Uomo shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to fabric mill delays, shipping carrier disruptions, supply chain shortages, labor disputes, natural disasters, pandemics, or government actions. In such circumstances, Franco Uomo will communicate with affected clients and make reasonable efforts to fulfill obligations as soon as practicable.

20. Limitation of Liability

‍ ‍

To the fullest extent permitted by applicable law, Franco Uomo shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability to any client shall not exceed the amount paid by that client for the specific service giving rise to the claim.

21. Dispute Resolution and Governing Law

‍ ‍

Franco Uomo is committed to resolving concerns fairly and promptly. If you have a complaint or dispute, please contact us first at style@francouomo.com. We will respond within 21 days and make every effort to resolve the matter directly before any formal proceedings are initiated.

‍ ‍

These Terms are governed by the laws of the State of California, United States. Any disputes not resolved through direct communication shall be subject to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California.

‍ ‍

22. Severability, Waiver, and Entire Agreement

‍ ‍

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Franco Uomo's failure to enforce any provision of these Terms on any occasion does not constitute a waiver of that provision or any future right to enforce it.

These Terms, together with any applicable order confirmation, invoice, and our Privacy Policy, constitute the entire agreement between you and Franco Uomo with respect to the subject matter herein and supersede all prior communications or agreements.

Your use of this website and our services is governed by our Privacy Policy, available at francouomo.com/privacy-policy. By using our services, you consent to the data practices described therein.
